The declaration was firmly endorsed, without qualifications, by the Soviet Union, the United States and other nations in the Helsinki Final Act of 1975, but Soviet endorsements of these principles was violated in practice. Thus, while Stalinist doctrines still reigned in the Soviet Union, Andrei Sakharov was declared a threat to national security and was denied the right to travel freely. Still denied the United States passport to which he as a United States citizen is entitled, still denied the essential due process of law in his lawful effort to obtain that passport through United States courts, his honorary Nicaraguan passport has now been revoked by a Nicaraguan government one can suspect took that action in response to United States pressure. The net effect for Philip Agee is that he has been denied, by the government of his own country, the right of freedom to travel to and from his own country that is his by constitutional guarantee and by treaty commitments to which the United States is signatory. Technically, perhaps, Philip Agee has not been denied anything. His United States passport was taken from him under color of law; his efforts to regain it, likewise, give the appearance that due process is being observed; the revocation of his passport by the sovereign government of Nicaraguan is unarguably something Nicaragua is privileged to do without explanation or justification. However, this is all a facade. Philip Agee, in fact, for the sin of using his first amendment right of free speech to expose and criticize the actions of the government of the United States, is being punished by that government without due process. Philip Agee's rights (and the rights of all of us) are being sacrificed on the altar of the false god of national security. I believe that the most shameful aspect of Philip Agee's dilemma -- as Melvin Wulf put it to Federal Judge Gerhart Gesell when petitioning last week for the grant of a temporary passport pending resolution of Agee's suit for issuance of a full passport as a matter of right -- is precisely that this denial of right is being done by the government of the United States under a false flag of due process. Philip Agee has been put between a rock and a hard place. He must choose between attempting to return to the United States in order to meet his business obligations or the possibility that without a passport he will not be able to return to Spain to be with his wife. What one sees here is the deliberate and despicable employment of Catch 22.
